JERSEY SHORE’S CUTEST BABY CONTEST RULES

NO PURCHASE OR OTHER CONSIDERATION IS NECESSARY TO PARTICIPATE IN THIS CONTEST; PURCHASE DOES NOT INCREASE CHANCES OF WINNING.

How to Enter for a Chance to Win
The entry period for the Contest will take place between June 28, 2010 at 9am and July 9, 2010 at 11:59pm ET. To participate in the Contest, you must enter via the following method: First you must become a member of the Magic Listener Club (if you are not already a member). To become a member, visit www.MagicVariety.com and follow the instructions on the Magic Listener Club registration page. Membership is free. Once you become a Magic Listener Club member, click on the Jersey Shore’s Cutest Baby Contest link on www.MagicVariety.com. Complete and submit the online entry form with your first and last name, complete address, city, state, zip code, telephone number, date of birth, a valid email address and a picture of your child who is between the ages of 0 and 2 at the time of entry. All entrants must also submit a user generated content submission release (available on the contest page) along with their entries. Contest entries will not be considered without the release. All pictures must be submitted in digital form in JPEG or GIF format (minimum 270 pixels wide and sized less than 1 MB) at www.MagicVariety.com (no hard copies or emails will be accepted). Pictures will not be acknowledged or returned. By submitting a photo(s), entrants authorize Magic 100.1 to post the photo(s) online at MagicVariety.com and use the photo for contest promotional purposes. Only parents/legal guardians may enter their child (no grandparents or other relatives or friends, neighbors, etc.). No professional photography allowed. Only one baby allowed in each photo entry. Only one entry per baby/child permitted. All photos must be in good taste; Magic 100.1 reserves the right to disqualify entries in its sole discretion.
Internet entries will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address.
Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by WJRZ-FM. WJRZ-FM’s computer is the official time keeping device for the Contest. Entries must be received by 11:59pm on July 9, 2010.

Voting
Beginning on or about 9am on July 12, 2010 until 12 noon ET on July 16, 2010 (Round 1), all eligible submitted photos will be posted online at www.MagicVariety.com. During Round 1, listeners and Contest participants will be able to rate the submitted photos from 1 to 10, with 1 being the lowest score and 10 being the highest. At the conclusion of Round 1, up to fifty (50) photos (the Round 1 finalists) will be selected by WJRZ-FM, in its sole and absolute discretion, to advance to Round 2, as defined below. WJRZ-FM will take the ratings into account when selecting the Round 1 finalists. A photo’s rating is the average of all the ratings received in that Round. Each person may only rate each photo once per rating period.
Beginning on or about 9am on July 19, 2010 until 12 noon ET on July 23, 2010 (Round 2), the photos of the Round 1 finalists will be posted online at www.MagicVariety.com. During Round 2, listeners and Contest participants will be able to rate the submitted photos from 1 to 10, with 1 being the lowest score and 10 being the highest. At the conclusion of Round 2, up to twenty five (25) photos (Round 2 finalists) will be selected by WJRZ-FM, in its sole and absolute direction, to advance to Round 3, as defined below. WJRZ-FM will take ratings into account when selecting the Round 2 finalists. Each person may only rate each photo once per rating period.
Beginning on or about 9am on July 26, 2010 until 12 noon ET on July 30, 2010 (Round 3), the photos of the Round 2 finalists will be posted online at www.MagicVariety.com. During Round 3, listeners and Contest participants will be able to rate the submitted photos from 1 to 10, with 1 being the lowest score and 10 being the highest. At the conclusion of Round 3, ten (10) photos (Round 3 finalists) will be selected by WJRZ-FM, in its sole and absolute discretion, to advance to the Final Round, as defined below. WJRZ-FM will take ratings into account when selecting the Round 3 finalists. Each person may only rate each photo once per rating period.
Beginning on or about 9am on August 2, 2010 until 12 noon ET on August 6, 2010 (Final Round), the photos of the Round 3 finalists will be posted online at www.MagicVariety.com. During the Final Round, listeners and Contest participants will be able to vote for one baby per day. The Round 3 Finalist that receives the most votes in the Final Round will be named the winner. In the event of a tie, WJRZ-FM Management will randomly select a winner from among all tied Final Round Finalists. The winner will be announced at approximately 8am on August 9, 2010, and will be contacted by phone and/or email.
Contest participants are permitted to rate or vote, as applicable, along with any other WJRZ-FM listeners. In order to vote in the Final Round for the Grand Prize winner, you must be a member of the Magic 100.1 Listener Club. To become a member, visit www.magicvariety.com and follow the instructions on the MAGIC 100.1 Listener Club registration page. Membership is free. The station is not responsible for ratings or votes not received because of difficulty accessing the internet, service outage or delays, computer difficulties, or any other technological difficulties. WJRZ-FM, in its sole discretion, reserves the right to disqualify any person tampering with the rating or voting process or who is otherwise in violation of the rules. In addition, any person tampering with the rating or voting process on behalf of one of the entrants will result in the disqualification of that entrant. All ratings or votes must be received by the closing of the applicable rating or voting period. During Round 1, Round 2, and Round 3, each person may only rate each photo once per rating period. During the Final Round, a person may only submit one vote per day.
For Rounds 1, 2, and 3, rating results will be taken into consideration in determining finalists, but final decisions will be made by MAGIC 100.1 Management in its sole and absolute discretion. In the Final Round, the eligible entry with the highest number of votes will be deemed the Grand Prize winner.
All contest entries will become the property of Station and will not be acknowledged or returned.

Prize
One (1) Grand Prize will be awarded. Grand Prize includes: one (1) Canon FS-100 Digital Flash Camcorder Valued at $399, one (1) Casio Exilim EXS-10 Digital Camera Valued at $249, one (1) Gift Certificate to Toys R Us/Babies R Us Valued at $500, one (1) Dinner Gift Certificate Valued at $100, one (1) Gift Certificate to CB Huntington’s Restaurant Valued at $50, one (1) Gift Certificate to Blackbeard’s Cave Entertainment Center Valued at $200, one (1) Gift Certificate to Seaside Furniture Valued at $250.
Non-cash prizes are not redeemable for cash. WJRZ-FM reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. Winners may not request prize substitution. Prize is non-transferable and may not be claimed or used by any person other than the winner. Winner must claim prize in person at the WJRZ-FM offices within 30 days after the end of the contest. Winner must provide valid photo identification (e.g. driver’s license, passport, state issued identification) when claiming prize. Prize not claimed within the 30-day period will be forfeited. The winner of gift cards will be subject to the terms and conditions of the gift cards as set forth by their providers.

Eligibility
All entrants must be at least 18 years old and legal residents of the United States, who have a child between the ages or 0 and 2, and are living or working in WJRZ-FM’s total survey area (as defined by Arbitron). Employees (including their immediate families and members of the same household) of Greater Media New Jersey, its affiliates, promotion sponsors, advertising and promotional agencies who do business with WJRZ-FM or any of the promotion sponsors, and other radio stations in WJRZ-FM’s metro survey area (as defined by Arbitron) are not eligible to participate in any contest presented by WJRZ-FM. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.” No groups, clubs, or organizations may participate in this Contest or reproduce or distribute any portion of these rules to their members. Limit one entry per baby/child; multiple entries per baby/child or per email address will disqualify the entrant. Void where prohibited.
Each submitted entry must be the original and creative work of each entrant and must not contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws. WJRZ-FM has the absolute discretion to disqualify an entry based on its sole judgment. WJRZ-FM, in its sole discretion, reserves the right to disqualify any entry if such entry contains illegal, indecent or otherwise offensive material, or if such entry contains material whose content is deemed at the sole discretion of WJRZ-FM to be unsuitable for the public (i.e. entries must be “clean”). Entries that do not comply with these rules are not eligible for the Contest. By participating in the Contest, entrants consent and agree that submitted entries, or any portion thereof, may be disclosed on air, posted on WJRZ-FM’s website, or in any other media at WJRZ-FM’s discretion.

Release
By entering, all participants agree to release and hold harmless the promotion sponsors, WJRZ-FM, Jersey Shore Broadcasting Corporation, and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won. Winner will be required to sign a form releasing WJRZ-FM and its affiliated companies from all liability in connection with the contest and the award and use of the prize before claiming the prize.

Disclaimer
WJRZ-FM undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s). WJRZ-FM is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station. WJRZ-FM is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest. If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of WJRZ-FM, WJRZ-FM reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).

License
Entry into any contest constitutes full permission for WJRZ-FM and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, submitted photograph of the participant’s child, face and likeness without compensation.

Taxes
WJRZ-FM will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099. Winner must provide his/her social security number to WJRZ-FM for tax reporting purposes, and is solely responsible for payment of all taxes incurred as a result of the award of a prize.

General
Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won. WJRZ-FM reserves the right to rule ineligible listeners who, in WJRZ-FM’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WJRZ-FM or its affiliates. WJRZ-FM reserves the right to cancel, suspend and/or modify this Contest and these Official Rules at any time, which changes will become effective upon announcement. By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WJRZ-FM and whose decisions with respect to all aspects of the contest are final and binding. Copies of written contest rules and the list of winners are available during regular business hours at the WJRZ-FM studio, 1001 Beach Street, Manahawkin , New Jersey 08050, for 60 days after the contest concludes.
As a condition to participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Ocean County, New Jersey having competent jurisdiction, which court shall apply the laws of the State of New Jersey, without regard to the conflicts of law principles thereof. The entrant and WJRZ-FM hereby waive any and all right to trial by jury. If any provision of these Official Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.
